Hello Sajha users, I am on H1B at the moment, and trying to start the adjustment of status under EB3. I had a dui in 2015, I did plead guilty which reflects in my record. Now my employer is hesitation to proceed with the processing claiming that DUI would be enough ground for denial. Please suggest your expertise.

Dui is a misdemeanor, it should not be a problem. But you must take help from experienced lawyer.

Agreed, DUI is a misdemeanour and is not under COMTD. While you will have to provide documentation for the record and might have to write a cover letter you should be fine. Plus how does your employer know about your DUI ?

They came to know about it during the process of LCA, when USCIS sent out RFE.
