As I am in student visa with no OPT now, my employer has already filed for the AOS/EAD and I-485. I have already got the receipt from USCIS. Now, as I have to register for the classes in college, will I get in trouble if I decide not to go to college anymore? Will it affect the process in immigration or not? I will appreciate if somebody will kindly suggest me what to do. Thank you, Roshani

yes to my knowledge you have to enroll in school, coz if not as a internationa student you would be out of status, and one cant sposnor someone who's illegal. but again, after you get the receipt, depending on the state, if you go and talk to them, and if you've been in that state for 9 months, which i assume u have, they should let you pay instate tuiton fee rather and outta state, but again some school will make you wait for 9 more months after you get the 1485 receipt. but again, you say your employer has filed your papers, but what about labor certification, i 140, and then only comes the 485.

mansion, correct me if i am wrong but one cannot file for LABOR in F1. [ F1 is a visa in which you cannot show the intent of NOT returning to HOME COUNTRY] hoina ra?

no, you're wrong, you can still go thru emplyement based PR even while you're in F1, i gotmine that way, while i was still in F1

Mansionji and Thapapjyu, thanks for the reply. But m still confused..my employer filed the petition in EB3 category. So, I think the best way is to talk to international advisor and figure out what to do next. Oh god!! I just dun want to go back to school......... Roshani

I don't know about the J1 but you have to be on somekind of status (for you its F1), unlit your intended status is approved. Just enroll in some fast track classes which start very late, that way if ur petition is approved before the classes start, you will get all your money back too.
