अमेरिकाको ग्रिनकार्ड भएकाहरुले आफ्नो श्रीमान्, श्रीमती वा २१ बर्ष नपुगेका अविबाहित छोरा छोरीको लागि ग्रिनकार्ड एप्लाई गर्न पाउने भएका छन् । युएस डिर्पाटमेन्ट अफ स्टेट सर्भिस अफ दि ब्युरो अफ कन्सुलर अपेर्यसले जुलाई महिनामा प्रकाशन गरेको भिसा बुलेटिन अनुसार अगष्ट महिनमा ग्रिनकार्ड भएकाले पनि आफ्ना परिवारको लागि तत्काल ग्रिनकार्ड एप्लाई गर्न मिल्ने भएको हो ।

बरिष्ठ अधिवक्ता खग्रेन्द्र क्षेत्रीका अनुसार यस अघी सम्म ग्रिनकार्ड होल्डरले आफ्नो परिवारलाई ग्रिनकार्ड दिलाउन २ देखी ५ बर्ष सम्म पर्खनुपर्ने भए पनि अगस्ट महिनामा भने तत्काल ग्रिनकार्डको लागि आवेदन दिन मिल्ने भएको छ । अधिवक्ता क्षेत्रीका अनुसार ग्रिनकार्ड होल्डरले आफ्ना परिवारलाई ग्रिनकार्डको लागि आवेदन दिए पश्चात पहिला वर्क परमीट आउने र त्यसपछि मात्र ग्रिनकार्डको प्रकृया अगाडि ब्यवस्था रहेको छ ।

FAMILY-sponsored categories (potential monthly movement)

Worldwide dates:

F1: Up to five weeks

F2A: Could become “Current” at some point during the coming months.

F2B: Four to seven weeks

F3: Three to five weeks

F4: Three to five weeks

August ma F2A current chha. Can anyone suggest about other F2B F3 visas. what is the timeline and what does that three to five weeks suggests

 I applied I-130 for my wife in november of 2011. My case is still at initail review. But the visa number is going to be available in August according to Visa Bulletin. Keeping my fingers crossed and paying taxes. :)

 Anyone have idea- how can approved asylee's(not greencard yet) spouse get benefited from this??
Please give some thought.

 Hi Zeran,
      I think that this rule won't benefit asylee's spouse as of right now. It is intended for GC holders only. 
Since  it is not clear how long the PD will remain current for, we can't predict something specific. But here are some thoughts.
 If the PD continues to remain current after month of August for more than one year or so, asylee's spouse might be benifited provided that asylee gets gc by then. It is better than having to wait for 2-3 years to get a green card as a spouse of GC holder.That's what i think. Btw has anyone heard anything about how long the PD will reamin current for? Please share some thoughts. Thanks.

 My I-130 Priority date is July, 2012. I filed through Vermont Service Center and still pending on initial review. I am planning to file 485 in august  and planning to collect all the documents. Only the issue is with Birh Certificate, I called my parents to make one from our VDC but there was nobody in VDC, like VDCsecretary and any  other official from govt. What shall I do in this case? Please share, if you guys have any difficulities while filling the I-485 form. When I listened BBC Nepali today, they said all VDC of Nepal prepares any kind of official documents in english but its not available in our VDC. What the heck.

This is for a friend of mine. How long it will it take to bring wife to US who has a green card and just got married? He is going to be US citizen by December 2014, almost 1 and half years from now. Will it be better for him to wait and apply for fiancée visa once he become citizen or filing petition now will be faster? Thanks in advance for your suggestion.

If u have a green card and if ur spouse or unmarried children under the age of 21 are legally present in US, u can apply for a green card on this august. On this august the date for 2A category are current so u can file both i130, i765 and i485  together. If u have all the required documents, ur spouse or a unmarried children under the age of 21 can get a work authorization card within 90 days and a green card within 4-6 months if everything went well. If u are not married yet, u can still marry ur gf/bf and file i130, i765 and i485 at the same time and will get a work authorization within 90 days and green card within 4-6 months. (Info given to me by a renowned immigration lawyer). I have no idea how it works if the spouse or children are out of the states since i didnt ask him(the lawyer) about it.

I am a LPR. My spouse is in the US. She is working as a graduate assistant at a university and receives monthly stipend. I am planning to file I-130 and I-485 together when visa becomes current in August. However, I am a student as well and my income does not exceed 125% of federal poverty level. I am worried about filing I-864. Do I have to file I-864 along with I-130 and I-485? If yes, will the fact that she is working and earning enough money to sustain herself play any role in the processing of her application?

 Hi,

I know that the visa is available from august-October, but is there any number of visas available within these months or we can file anytime within these months? It’s because my documents are taking time and it would still take 2-3 weeks to send it? Do you guys think i should be fine if I file after 2-3 weeks?

Hi Greetings My husband filed F2A visa (I-130) last year for me and I am currently living in Nepal. I have a priority date of August 08, 2012. The I130 has not been approved yet. I just wanted to know if my case will be able to take advantage of the current priority date for F2A this August 2013? Please let me know What should be done next to be eligible for this?

Yes, you need to file I-864 along with other forms I-130, I-485 etc. Your spouse's income can be added along with your income for I-864. However, USCIS might not consider income of intending immigrant (your spouse) from the University because the employment (graduate assistant) in the University is short-term employment.

I don't really get what you mean by visa is available from august-october. If you are talking about the priority date (PD) being current for F2A category, the PD is current only in August, so far, as per USCIS visa bulletin. So, your application should be received by USCIS before August 31 ( better to keep few days margin) for F2A category.

The priority date for F2A category is current in August.This is applicable only for adjustment of status of spouses (and unmarried sons and daughter below 21) o permanent residents. The beneficary should be present in the United States. I don't think you can get any benefit from it ( unless you have a different story which you have not mentioned in the post).
