this is how it works according to new law -

1. submit application with fee but with no other supporting documents yet.

2. application is reviewed for eligibility i.e. experience etc meets NOC list.

3. will recieve a letter saying to go further or not. if go further then you are given four month period to collect and submit rest of the documents.

4. then wait fr 16 months or more.

or check their website.

hope this helped.

hi lotu,

if u google 'canadia immigration' u should be able to find the site. cause i don't rememer the web link right off the bat. they have recently changed the law back in feb 2008 and application procedure is also slightly changed. find the link that says 'FEDERAL SKILLED WORKER' and this is called as 'CATEGORY 1'. the guide is pretty simple and straight forward so u should be okay.

jaijai - give it another few weeks.

good luck

Dear friends snowfed_river and jaijaijaijai, thank you so much for your valuable suggestion. I have gone through the webite that you have given. I wonder we need to fill all the forms like:

Forms

Application for Permanent Residence in Canada (IMM 0008)

Schedule 1: Background/Declaration

Schedule 3: Economic Classes – Federal Skilled Worker

Additional Family Information (IMM 5406)

Use of a Representative (IMM 5476)

at the beginning. Can you tell me what does it mean?

2 self-addressed mailing labels one in English or French and the second in the official language of your country

One more question, do you think we need to take IELTS if we have got two year degree as a full time student from united states to show the english profiency. Thank you so much and sorry to bother you.

News Release

Minister Kenney announces immigration levels for 2009; Issues instructions on processing federal skilled workers

Ottawa, November 28, 2008 — Canada will stay the course on immigration in 2009, welcoming between 240,000 and 265,000 new permanent residents, Jason Kenney, Minister of Citizenship, Immigration and Multiculturalism, announced today.

“While countries such as the United Kingdom and Australia are talking about taking fewer immigrants, our planned numbers for 2009 are on par with last year and are among the highest for this country over the past 15 years,” Minister Kenney said. “The numbers reflect a continued commitment to an immigration program that balances Canada’s economic, humanitarian and family reunification goals.”

The 2009 plan includes up to 156,600 immigrants in the economic category; 71,000 in the family category; and 37,400 in the humanitarian category.

Minister Kenney also announced another step in measures to improve the immigration program’s responsiveness to Canada’s labour market. Retroactive to February 27, 2008, the date specified by the Federal Budget, the Action Plan for Faster Immigration includes issuing instructions to visa officers reviewing new federal skilled worker applications to process those from candidates who:

  • are in 38 high-demand occupations such as health, skilled trades, finance and resource extraction; or
  • have an offer of arranged employment or have already been living legally in Canada for one year as a temporary foreign worker or international student.

The list of 38 occupations was developed after consultations with the provinces and territories, business, labour and other stakeholders. New federal skilled worker applications that do not meet the eligibility criteria outlined above will not be processed, and the application fee will be fully refunded. This, along with funds set aside in the 2008 Budget to improve the immigration system, will stop the backlog from growing and will start to draw it down.

“The eligibility criteria apply only to new federal skilled worker applicants and will not affect Canada’s family reunification or refugee protection goals,” said Minister Kenney. “Applicants who aren’t eligible for the federal skilled worker category may qualify under another category, such as the Provincial Nominee Program, or as temporary foreign workers, which could then put them on a path to permanent residency through the new Canadian Experience Class. There are many ways to immigrate to Canada.”

The Department has expanded its website in an effort to make it easier for people to navigate the range of immigration options open to them. The site now includes a specific section for employers (www.cic.gc.ca/employers) and a new interactive tool (www.cic.gc.ca/cometocanada) that matches information provided by potential applicants with immigration programs that best suit their circumstances.

“We expect new federal skilled worker applicants, including those with arranged employment, to receive a decision within six to 12 months compared with up to six years under the old system,” said Minister Kenney. “All other economic class applications—including applicants chosen by Quebec, provincial nominees, the Canadian Experience Class, and live-in caregivers—will continue to be given priority.”

These improvements, coupled with a number of recent initiatives that include the introduction of the Canadian Experience Class, bring Canada in line with two of its main competitors for highly skilled labour: Australia and New Zealand. Both of these countries have eliminated their backlogs and have systems that deliver final decisions for economic applicants within a year.

“The recent steps this Government has taken to improve our immigration system will help ensure that Canada remains competitive internationally and responsive to labour market needs domestically,” said Minister Kenney.

IF you are not in one of the occupations in the 38 high-demand list, your application will be returned, and application fees will also be refunded (if you applied after Feb 27, 2008). New applicants.. determine if you are really eligible to apply.

Those who applied prior to Feb 27, 2008 are OK.. don't worry.

But those after that DATE are doomed.... Canada need more like bhariya type of people.... so you better fake your credential as cook, plumber and so on.. and apply. It's easy to get diploma of cook, chef or Plumber in NEpal.. so use that and apply and enter Canada.. then later you can pursue jobs related to your real qualification. Hoina ta? If there is a will, there's always a Way.

Ved555 thank you so much for the informaiton. I am applying in "College and Other Vocational Instructors" category. Do you think that I am a genuine candidate if I have taught more than 5 years in plus 2 colleges in kathmandu for this category?. Thank you so much. Further information is highly appreciated.

I think you are the perfect candidate under the category  4313, so just take a self-assessment Test from the following link, you need to secure 67 points mark. If you have a wife with bachelor's degree you also get 5 points for that. Make sure you take IELTS or TOEFL test for getting as high as possible score under the language category. All the best.

http://www.cic.gc.ca/english/immigrate/skilled/assess/index.asp

Now, there is no preliminary application like filling a 3-page initial application form and wait for thier response and instruction to fill the full application forms and furnishing the requireed documents.

Now you apply with all the documents you have in hand... make sure those documents are notarized from the public notary. In Nepal there are 30 or 35 lawyers who are now eligible to notarized your various documents. You do not have to go to Kitab Byevastha Karyalaya in Babar-Mahal.

It's not going to take 6-7 years for processing the application for PR now. Becsue as per Minister Kenny's annoucement, it will be speed up considerably to do away with the backlog.

So Bad news to guys who are not in the above 38 high-demand occupations, if yo have applied after Feb 27th 2008, your application forms and fees will be returned. SORRY about that.

Hi Ved555/or Sajhagoers I got a question for you. Let us hypothesize that the person A has taken the part time instructor job in Y institution for a year in Nepal. Taking into consideration that A's work 2 hours/week Then, A joins some university aboard as a full time research student towards PhD degree under university scholarship program. But, in passport A has already mentioned profession as lecturer. Now, does his study aboard working in lab as research student can be counted in his job experience? Does it really matter about the pay scale of the applicant or not? Thanks for info.

Abhagi Kale,

I applied my PR application on September, got back of my application package for correction on October.
Two month has passed I sent my corrected application. I came to know from one of my friend that I need to wait about six months for the approval letter. I am waiting & waiting for another four months. ! If it is true, I hope they will let me know further about submitting medical or IELTS reports and/or so on.

Never ever apply as a Nepali Engineer.

Canadian government had had enough bad reputation with Nepali Engineers. These people had pill up fake experiences but did not pick and move any thing else in their work experiences. These people just did bribery, corruption and national crimes.. so Canadian government found their background, skills and work histories.

some of them deported to Nepal, too.
