Hey guys,

I need your expertise to filing this year's tax. Its been 2 yrs I am here in US and filing tax as a resident, though I was in F1 status. I even worked using my SSN to work offcampus and used W2 of that work while filing tax. Now I am in H1B and want to file tax legally, as an international. Is it okey to file 1040 NR after filing 1040 for two year? What might be its consequences?

Your suggestions are highly appreciated.Thanks in advance

Kiran_SH,

I was in the same boat. I first filed 1040NR as a student, then after a couple of years switched to 1040EZ while I was still in F1. I went to H&R Block to file taxes after I got my H1 but their system processed a 1040EZ for me despite of the fact that I was a non-resident alien. So personally I do not think it really matters as long as you are paying taxes and not deceiving the government. Also, after 5 years of your stay in the U.S., you are eligible to file your taxes as a resident.

I would suggest you either file taxes online ( Turbotax.com- $30, are you a resident -Y/N is not a part of the questionnaire) or go to H & R Block, pay $100 - $20 rebate = $80 to file it with a tax professional.

There are several free filing websites posted on IRS.gov site....Good Luck....Oh, don't forget the $30.00 Telephone tax credit this year.....its for everyone to benefit from !!

If you are on H1, you file 1040A.... because basically u pay your taxes in same manner as americans do. so for Tax pruposes, you are permanent residence :)

By the way, the telephone credit.... does that apply to cell phones too??

. Yes I heard it applies for cell phone also. One of my friends told me that he read somewhere while doing his taxes. I am gonna use the telephone credit. Lets see how it goes.

Advice from sajha tax experts would be helpful, though.

I use taxslayer.com It is only 9.99 for both federal and state return, which is quite cheap and it is quite easy to use.

Use one of the free sites listed on IRS.GOV Hi_Nanu....

If you are talking about the Telephone Tax Credit, its one time $30.00 credit for everyone.......

I am here since 2003 January. Until Last year I filed 1040 NR as I was in F1 status until last September. I am in H1B since last October. Which form should I use? Will there be any problem if I use 1040 for US residents. I am planning to apply for GC very soon. WIll 1040 have any impact on GC?

Can some one working on OPT under F1 status use E-Filing? Has anyone done that before? I heard international students shouldnt use E-filing.

you have to submit the seperate state tax form in both states. But you have to submit the single for federal.
