Hi Everyone,

I am in  trouble right now. My US visa (I got DV) expires in July 2010 and I am currently in canada with my permanent residence status. I do not want to loose my canadain status because I will be canadian citizen before August but the I have to enter US by July to maintain my status. IS there anyone who has same problem of mainating both status?? I want to stay in canada maintaining US status. Is it possible.

Please share your ideas... Your help will matter a lot...

Looks like your months are screwed up as we currently stand on 27 OCT 2010. Let me give you a generic answer. While you are living in Canada in PR, leaving the country temporarily does not impact on your status. You must be present at least two years ( or may be three) out of five consecutive years to maintain your PR in Canada. After living in Canada for 3 years (accumulated basis - not consecutive), you can file for Citizenship.


I don't see how you will be able to maintain your US GC while living in Canada though. If you are away from the country without valid reason (eg., working for US company outside of US etc.) for more than one year, then you automatically lose US GC.... Hope this answers your question.

Questions?

How come you do not have a Greencard if you were selected for DV? Where did you obtained the visa from?

Why did you apply for DV if you already possessed PR in Canada?

Were you drunk at the new year's eve and only woke up yesterday to submit your papers that were overdue back in July?

Its almost November, are you a Canadian Citizen now?

If you are referring to the year 2011; you can come to US, get the Greencard and return to Canada. Once you obtain Canadian citizenship, its up to you where you want to stay for the rest of your life. If you want to apply for US Citizenship after that, you have to live in US for at least 5 years.

Thanks for the reply.. I have green card and we get the rentry permit for july 2011. We have to enter US within that time. But  due to some personal reasons I can not go on that time.. I am asking,, is there any way like, there is  a entry stamp in my passport to US but not the exit one so that it seems like I have been living in US.. I can go in June 2011 but have to return back for July. People say if you travel through land border there is no stamp on the passport.. I do not want to loose my greencard. If anyone whos is in same situation.. please reply..

Its funny assumption that the USCIS would not know if you are out of country since "there is a entry stamp in passport to US but not the exit one".


I beleive there are few nepalese who are as lucky as you are who get DV and Canada PR. And how come you have reentry permit for July 11? My understanding is a green card holder can entry any time to USA. You need a valid passport and Green Card, not a visa. Your question and timeline for some reason does not make a sense.


And last piece of suggestion-try to be legal whether in USA or CANADA so that you dont loose both in greed.

Prabbina: As I mentioned earlier, your quest to retain US GC while living in Canada is not possible in the long term. So do you want to go through the pain? I have been through a similar situation. In the end, you have to choose one and then stick to it... Good luck.
